NEW BRUNSWICK: Robert Veras-Toribio and Kelvin Lantigua Killed In Car Accident On Freeway Route 18 After The Vehicle Crashed Into A Guardrail and Fell Into the Raritan River

CITY MAY BE LIABLE FOR FATAL ACCIDENT FOR INSTALLING INADEQUATE RAILING NEW BRUNSWICK, NEW JERSEY (July 25, 2016) – A 22-year-old man and his 21-year-old passenger were killed in a car accident after their car pierced through a guardrail and went into the Raritan River  while the vehicle was traveling down the freeway on Route 18, according to CBS News. Authorities have been able to identify the two men that died as Robert Veras-Toribio and  Kelvin Lantigua. Emergency medical workers rushed to the scene of the crash in order to try to rescue the men from the car submerged in water, but they were later pronounced dead. Police are saying that Robert Veras-Toribio and  Kelvin Lantigua were traveling north when for some reason the driver lost control of the vehicle. The collision happened Monday morning around 1:00 a.m. Investigators are still working to determine the cause of the crash, but there may be liability on the part of the guardrail manufacturer or city that installed the railing. The city has an obligation to create and maintain safe roads. Guardrails are typically placed in locations where their absence would prevent an even greater risk to the public. For example, a guardrail may be placed along the highway near a solid fixed object like a metal poll in order to prevent cars from striking it. Similarly, the city is obliged to install adequate guardrails that serve their purpose and to make sure that those guardrails are well maintained. If a normal car traveling down the road is able to puncture a guardrail that's protecting drivers from a river, that's a very dangerous situation. It may have something to do with structural deficiencies of the guardrail itself. (UPDATE) BROOKLYN: Andrew Esquivel, MIT Student, Killed In Car Accident After Drunk Off-Duty Cop Crashes SUV Onto Sidewalk In Williamsburg

NYPD MAY BE LIABLE IN DEADLY CRASH BROOKLYN, NEW YORK (July 19, 2016) One person has died in a tragic car accident after a drunk off-duty cop crashed his SUV onto a sidewalk in Williamsburg, according to the NY Post. Authorities have been able to identify the man that was killed in the collision as MIT student Andrew Esquivel. Three other people were seriously injured in the crash. They have been identified as Divya Menezes, Sophia Tabachoun and James Balchaunas. Andrew Esquivel and the other MIT students were heading back to their apartment after getting off the train. The off-duty police officer was spotted swerving and speeding just moments before mounting the curb on Bedford Avenue by North Eighth Street. Witnesses describe the scene of the accident as chaotic. One person sustained a serious leg injury and another was pinned against a fence by the vehicle. Emergency medical workers rushed to the scene of the accident and later pronounced  Andrew Esquivel dead. The intoxicated officer was arrested following the crash and charged with manslaughter. He was being held on a 300 thousand dollar bail and was later released after paying. The officer that was arrested had a number of pictures on his Facebook page of him with alcohol where he bragged about his drinking prowess. This isn't the first time that a drunk off-duty cop has caused serious injuries. The NYPD is currently being sued for 90 million after a drunk off-duty police officer violently attacked a random pedestrian with his service pistol and almost killed him. The lawsuit alleges, in part, that the NYPD's lax policies on alcohol abuse are what contributed to the attack. BROOKLYN: Divya Menezes Seriously Injured In Car Crash After Drunk Off-Duty New York Police Officer Caused Pedestrian Accident In Williamsburg

New York City May Be Liable For Deadly Car Crash BROOKLYN, NEW YORK (July 16, 2016) Authorities have arrested an off-duty New York Police Officer after he caused a fatal car accident with his SUV that left one person dead and seriously injured three other people, according to the New York Post. Authorities have been able to identify the man that was killed in the accident as Andrew Esquivel. The collision took place early Saturday morning when the off-duty cop lost control of his SUV by Bedford Avenue and North Eight Street. The cop drove his car onto the sidewalk after swerving and speeding. One person's leg was severed and another pedestrian was violently pinned against a fence after the crash. Police were also able to identify a woman that was critically injured in the crash as Divya Menezes. A family member of the victim's said that at least three of the people that were injured were graduates of the Massachusetts Institute of Technology (MIT) and were currently living in Williamsburg. The two other victims have been identified as Sophia Tabachoun and James Balchaunas. Divya Menezes, Sophia Tabachoun and James Balchaunas were all rushed to the hospital following the accident in order to receive treatment. The accident on Saturday isn't the first time that an off-duty NYPD officer got drunk and caused mayhem. It is the latest in a long string of incidents. There is a 90 million dollar suit pending against the NYPD after an off duty officer got drunk and viciously attacked a random pedestrian with his service pistol. The man in the incident was nearly killed after being hit with numerous shots. Another man could have very easily died had he not missed the hailstorm of bullets. BROOKLYN: Andrew Esquivel Killed In Car Accident After Drunk Off-Duty Cop Crashed His SUV Onto Sidewalk By Bedford Avenue

NYPD MAY BE LIABLE FOR FATAL ACCIDENT BROOKLYN, NEW YORK (July 16, 2016) A 21-year-old man has died an three others were injured in a tragic car accident after a drunk off-duty cop crashed his SUV onto the sidewalk by Bedford Avenue, according to the NY Post. The off-duty police officer responsible for the accident has been charged with manslaughter. Prosecutors were able to identify the man that died as Andrew Esquivel. He has been identified as an MIT student. Authorities are saying that the collision took place in the early morning hours of Saturday after the drunk off-duty officer made a right turn from North Eight Street. Paramedics rushed Andrew Esquivel to the hospital where he was later pronounced dead. He appears to have been the only person that died in the fatal crash. Three other people were seriously injured, including one pedestrian who sustained a severed leg. One person was seriously hurt after the SUV pushed him against a fence. Prosecutors were able to identify the three other pedestrians that were injured in the crash as Divya Menezes, Sophia Tabachoun and James Balchaunas. At least three of the victims were Massachusetts Institute of Technology (MIT) graduates who were living in Williamsburg. They were heading home after getting off the L train. There was an outpouring of grief and anger on Facebook. One user by the name of Lisette Reyes wrote, " Oh my God! NYPD needs to address the high incidence of alcoholism in their ranks. Stop ignoring this problem, many NYPD I know drink and drive probably partially because they know they'll be afforded "professional courtesy" if they get caught but they're putting everyone, and their own careers, at risk." It's time that the law catches up to these rogue officers who think that they can rise above the law simply by flashing their badge. Saturday's accident is the latest in a long string of accidents involving drunken NYPD Police Officers. The NYPD is currently facing a lawsuit for 90 million dollars after a drunk off-duty cop randomly started shooting his service pistol at pedestrians and nearly killed a man. This accident may very well be indicative of a larger problem involving the Police Department's refusal to deal with alcohol within their own ranks. If this is the case, then the NYPD may very well be liable for the deadly crash on Saturday morning. There needs to be a thorough investigation into the NYPD and how they are dealing with officers who have problems with alcohol abuse. The Facebook profile belonging to the police officer in this instance showed him with alcohol in around a half dozen pictures. BROOKLYN: Drunk Off-Duty NYPD Cop Causes Car Accident Killing One And Injuring Three Pedestrians After Police Officer Crashes SUV Into Sidewalk

CITY MAY BE LIABLE FOR DEADLY CAR ACCIDENT BROOKLYN, NEW YORK (July 16, 2016) One man was killed and three other people were seriously injured when a drunk off-duty NYPD Cop drove his SUV onto the sidewalk, according to the New York Post. Authorities are saying that the crash happened early Saturday morning when the off-duty police officer was driving his  gray Dodge Durango SUV. Witnesses say that the officer was speeding and swerving before the crash. The victims were walking past a Bedford Ave. townhouse in Williamsburg at the time of the collision. Authorities have been able to identify the 21-year-old man that was killed as Andrew Esquivel. Prosecutors were able to identify the three injured pedestrians as Divya Menezes, Sophia Tabachoun and James Balchaunas. The victims were hospitalized and received treatment for their injuries. Neighbors came out of the houses after they heard the accident on Bedford Avenue near North 8th Street. The scene was completely chaotic with numerous injured pedestrians. One man had his leg torn off in the collision and another male victim was impaled on a fence. Emergency medical crews rushed to the scene of the accident and were able to pronounce one man dead. Early reports suggest that the off-duty cop tried to flee the scene but he was detained by witnesses and later charged with driving under the influence (DUI). A Facebook profile believed to belong to the officer shows him with alcohol in around a half dozen photos. Typically the city can be held liable for the negligence of police officers so long as they are working within the scope of their employment at the time of the accident. The officer in this instance did appear to be off duty, though he was scheduled to show up for work in a few hours. However, a new theory of negligence working its way through the courts could hold the NYPD responsible for the deadly accident. There has been a history of incidents involving drunk NYPD officers which would seem to be indicative of a systemic problem. The New York Police Department is currently facing a 90 million dollar lawsuit over an off-duty officer who got drunk and randomly shot a man six times nearly killing him. This accident may very well be an outgrowth of the New York Police Department's refusal to deal with the problem of alcohol abuse within its ranks. We implore the NYPD and Mayor De Blasio to take measurable steps to fix this problem before even more people end up dead. Our staff at the RMFW Law Firm were heartbroken to learn about this tragic car collision in Brooklyn. (UPDATE) BROOKLYN: 60-Year-Old Woman Raped And Punched In Violent Assault By Attacker At Apartment Boiler Room on Berriman Street

IF YOU HAVE INFORMATION ON WHERE TO FIND THE ATTACKER PLEASE CALL POLICE: 1-212-267-RAPE BROOKLYN, NEW YORK (July 16, 2016) Police are searching for a man that violently attacked and raped a 60-year-old woman in the boiler room of an apartment complex by 463 Berriman Street in East New York, according to ABC 7. Police officers received a call at around 6:00 a.m. that a woman had been repeatably punched in the face and raped. The woman was grabbed from behind and dragged in the boiler room. The sexual assault took place in the basement of the apartment building on Berriman Street. Officials are saying that the victim was with a friend prior to the assault collecting recyclables. Authorities have been able to identify the suspect as black and wearing maintenance type clothing before fleeing. An investigation into the attack is being done by Brooklyn Special Victims Squad. Some of the residents of the apartment building where the rape took place say that the basement has had a history of break ins. The super of the building has made some attempts to secure it, but the break ins kept happening. One of the key elements of negligence is foreseeability. The history of break ins at this apartment complex likely made it foreseeable that there would be future break ins. The property owner at the apartment building where the assault took place may therefore be liable for assaults resulting from break ins. Had the basement been properly secured in such a way to prevent future break-ins, then this tragedy may never have happened. We implore the NYPD to conduct a thorough investigation into this vicious assault. There needs to be steps taken IMMEDIATELY to properly secure the basement of the apartment in order to prevent a similar attack. Unfortunately, many property owners fail to keep their premises safe until they are left facing down an enormous lawsuit. Thy NYPD Has Provided a Photo of a Possible Suspect: Robert Wolff Robert H. MASONVILLE: Shayne Charles Injured In Home Explosion Accident After Lighting Propane Hot Water Heater In Basement

GAS COMPANY MAY BE LIABLE FOR INJURIES AND HOME EXPLOSION MASONVILLE, NEW YORK (July 16, 2016) A 31-year-old man is in critical condition after a home explosion on Wednesday when he attempted to light a propane hot water heater in the basement, according to 12 Action News. Authorities have been able to identify the man that was injured as Shayne Charles. Two people that were passing by the home were able to extract the man from the basement of the house. He was later transported to the Upstate Medical Center in Syracuse. Delaware County Emergency Services rushed to the scene of the accident following the explosion. Delaware Fire Deputy Officials said that the house caught on fire at 3949 State Route 206 and eventually burned to the ground. There was also a woman outside the home at the time the propane tank exploded. Kerry Vaccaro, 29, from Mount Upton was injured in the blast and later transported to the hospital for her injuries. The updated medical condition of  Kerry Vaccaro and  Shayne Charles remain unknown at this point. An investigation into the accident is still ongoing, but the local gas company may be liable for the home explosion. Most gas explosions are a result of some problem with the gas line, the propane tank or an appliance. It's disappointing and unfortunate that this incident was labeled an "accident" in the absence of a lengthy investigation. If the gas company had some degree of negligence in this tragedy, then they should be held accountable. RICHMOND TOWNSHIP: Charles Pesce Killed After Being Run Over In Semi-Truck Accident At Speedway Gas Station Parking Lot

TRUCKING COMPANY MAY BE LIABLE FOR DEADLY ACCIDENT RICHMOND TOWNSHIP, PENNSYLVANIA (July 10, 2016) A 69-year-old man was killed in a tragic accident after he was run over by a truck driver and dragged through the parking lot of a Speedway Gas Station, according to Berks and Beyond. Authorities have been able to identify the man that was killed in the pedestrian accident as Charles Pesce. The Speedway gas station where the tractor-trailer accident took place is by Route 222 and Farmers Drive. The truck driver seems to have not scene Charles Pesce as he was in front of the truck. Emergency medical workers showed up at the scene and later pronounced him dead. Authorities will continue to investigate the car accident in order to determine liability. A full investigation is still pending, but the company that the truck driver worked for may be liable for the accident if the driver of the big rig is found to be at fault. BRONX: James Frierson, 5, Injured After Falling From 5th Floor of Apartment Building on Bristow Street

INADEQUATE WINDOW GUARD MAY BE RESPONSIBLE FOR TRAGIC ACCIDENT BRONX, NEW YORK (July 6, 2016) A 5-year-old child was seriously injured after falling 5 stories threw a window at an apartment building on Bristol Street, according to CBS News. ( map) Reporters have been able to identify the boy that was injured as James Frierson. The accident happened on Tuesday in the Crotona Park East section of the Bronx. This comes just two days after a three-year-old fell to his death at an apartment complex in Harlem. Investigators indicated that there were window guards properly in place at the apartment where the boy fell. Yet, somehow, the boy was able to fit through the open window.  The window guard that James fell threw was subsequently replaced with a taller guard in order to prevent a similar accident. The boy is currently listed in stable condition at NewYork-Presbyterian/Columbia University Medical Center. There may be liability on the part of the building owner if inadequate window guards were installed in the boy's apartment. According to Title 24: Department of Health and Mental Hygiene, window guards on sliding windows must have solid metal blocks attached to the window which prevent the window from opening more than 4 1/2 inches from the guard. The relevant passage reads as follows: (1) Sliding windows. A solid metal block, measuring at least one half the depth of the window track and one half the width, shall be securely fastened by two (2) screws into the bottom window track, and a solid metal block or an "L" shaped metal stop shall be securely fastened* by two (2) screws into the upper window track, to prevent the window from opening more than 4 1/2 inches. Had the proper window guard and stopping blocks been in place this tragedy may never have happened. This is just one of the things that investigators will need to look at. HELPING THOSE IN NEED BY RAISING AWARENESS At the RMFW Law Firm we believe in giving back to the community and helping those who are in need. If you or someone that you know has been affected by this accident, we will gladly help raise awareness of any gofundme campaign set up to support the victim or their family. We can link to it in this post which is then spread across our social media platforms. You can send your request to: gofundmerequest@gmail.com. Our staff at the RMFW Law Firm were deeply saddened to learn about this terrible accident. It is an absolute relief that James is alive and recovering from his injuries. Many children do not survive falls from similar heights. Our thoughts and prayers are with the family as they work with their child down the long road to recovery. It is outrageous that the building management thinks that it can make things right for this family by installing a taller window guard after an accident has already taken place. Who knows how many other children are at risk in the same building by window guards that don't meet safety standards? If there is any guidance at all that we can provide for the family of this accident as they work to secure their legal rights, our phones are always on 212-344-1000.
