The Risks Associated With Backover Accidents in NYC

Posted on Jun 7, 2016 in Car Accidents, Personal Injury

Backover accidents are more common than many people realize. Whether you are in New York City or elsewhere in the state, the results of such accidents can be devastating to everyone involved. In general, a backover accident is one in which the operator of a motor vehicle backs his or her vehicle into a biker or pedestrian. More often than not, such accidents occur when the driver is backing out of a driveway or parking space.

Unfortunately, there is a recent example of a backover accident that ultimately resulted in a 76-year-old woman’s death. According to NBC New York, the woman was hit as she was attempting to cross the street mid-block at Madison Avenue when the vehicle driver was attempting to back into a parking space. When the woman was taken to the hospital, she was alert and conscious; however, she passed away a week later from the head injuries sustained in the accident.

What You Need to Know About Backover Accidents

Backover incidents typically happen at low speeds and tend to involve SUVs and pickup trucks, particularly since they sit higher off the ground and have more blind spots. As a matter of fact, research shows that SUVs and pickup trucks are more likely to be involved in backover incidents than cars.

The Insurance Institute for Highway Safety (IIHS) notes that, on a yearly basis, 300 fatalities stemming from auto accidents occur due to backover accidents. However, it should also be noted that since these types of accidents typically happen in driveways and other off-road locations, tracking such cases statistically is a difficult task.

The National Highway Traffic Safety Administration (NHTSA) estimates that just about two-thirds of injury-causing accidents happen in driveways or parking lots and 40 percent of accident fatalities take place in those same locations.

The age groups that are most affected by backovers are the elderly and small kids. Elderly individuals typically do not see the automobile coming toward them or they may not be quick enough to move out of the way of the vehicle. Children, especially small ones, may be missed by a driver — even in cases where the driver looks into the vehicle’s mirrors when backing out.

Kids and elderly individuals represent the largest number of backover accident victims. Statistically, 35 percent of the 300 fatalities that occur yearly due to backover crashes are children under five years of age, while over 25 percent of the fatalities were people 70 years old and older.

Backover accidents can involve a number of complex issues and concerns for injured parties. That said, it is very important for harmed individuals to work with a skilled New York City injury lawyer who knows and understand the complexities and the overall sensitive nature of such cases.
